Terms of Service for boopstr

Welcome to boopstr, PBC ("boopstr," "we," "our," or "us"). We are a Public Benefit Corporation incorporated in Delaware. These Terms of Service ("Terms") govern your access to and use of our websites, mobile applications, waitlist and email signup pages, and related services (collectively, the "Services"). By using the Services—including joining our waitlist—you agree to these Terms.

1. Acceptance of Terms

• By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
• If you do not agree, do not use the Services.

2. Who We Are & Location

• boopstr, PBC is incorporated in the State of Delaware, United States.
• Our mission as a Public Benefit Corporation is to build a privacy-first, community-centered experience for pet parents.

3. Eligibility

• You must be at least 16 years old to use the Services. boopstr is not intended for users under 16 years of age.
• If you are under 18, you must have consent from a parent or legal guardian.
• By using the Services, you represent and warrant that you meet these age requirements.

4. Accounts & Bluesky Sign-In

• You may sign in using your Bluesky account. When you do, your use is also subject to Bluesky Social's Terms of Service and Privacy Policy.
• boopstr never stores your Bluesky password, and you are responsible for safeguarding your credentials.
• Content you choose to share to Bluesky from boopstr is governed by Bluesky's policies and may appear outside boopstr through federation.

5. Waitlist & Communications

• By joining our waitlist, you consent to receive emails about product updates, launches, and changes to these Terms or our Privacy Policy.
• You can unsubscribe at any time via the link in our emails. Waitlist emails may occasionally include product updates.

6. Privacy

• We collect only the personal data necessary to provide and improve the Services.
• We do not sell your personal information to third parties.
• Advertising is not part of our current model. If the landscape changes, we will always put your data privacy first.
• We use multiple third-party resources (e.g., Supabase and Altcha) to deliver features; see Section 12 for details.
• Please review our Privacy Policy for full details on data practices and your choices.

7. Your Content & License to boopstr

• You retain ownership of content you submit (e.g., pet profiles, photos, posts, memorials, wishlists).
• You grant boopstr a limited, non-exclusive, worldwide, royalty-free license to host, display, and distribute your content within the Services, solely to operate and improve boopstr.
• Depending on your settings, certain content (e.g., memorials or wishlists) may be publicly visible. Please post responsibly.

8. Community Standards

• Follow the golden rule: treat others as you would like to be treated.
• Do not post or promote animal cruelty, unlawful pet sales, or misleading adoption information.
• Do not harass, defame, or harm others; do not share hateful, obscene, or exploitative content.
• Do not post nonconsensual intimate imagery (NCII), including authentic images or AI-generated/digitally altered depictions ("deepfakes") of any individual without their consent. This includes images depicting nudity, sexual activity, or intimate body parts.
• Respect intellectual property rights and applicable laws.
• Report concerning content through available channels; we may remove content or suspend accounts that violate these Terms.

9. Prohibited Activities

• Do not attempt to disrupt, attack, or impair the Services, or circumvent security features.
• Do not use automated tools (bots, scrapers) without our prior written permission.
• Do not attempt to access another user's account or personal information.
• Do not post, distribute, or threaten to distribute nonconsensual intimate visual depictions of any person.

10. Nonconsensual Intimate Imagery (NCII) Policy & TAKE IT DOWN Act Compliance

In compliance with the federal TAKE IT DOWN Act (effective May 19, 2026), boopstr prohibits the publication of nonconsensual intimate visual depictions and maintains the following notice-and-takedown procedures:

10.1 Definitions

• "Intimate visual depiction" means any photograph, film, video, or digital image that depicts nudity, sexual activity, or intimate body parts of an identifiable individual.
• "Nonconsensual" means the depicted individual did not provide affirmative, conscious, and voluntary authorization for publication.
• "Digital forgery" or "deepfake" means any visual depiction created or altered using artificial intelligence, digital editing, or other technological means to realistically depict an identifiable individual.

10.2 Prohibition

Users may not publish, share, or distribute any intimate visual depiction—whether authentic or digitally created—of any individual without that individual's consent. Violations may result in immediate content removal, account suspension or termination, and may be reported to law enforcement.

10.3 Reporting NCII on boopstr Content

If you are depicted in nonconsensual intimate imagery posted within boopstr (not content federated to Bluesky), you or your authorized representative may submit a removal request to:

Your request must include:

• Your physical or electronic signature (or that of your authorized representative);
• Identification of, and information sufficient to locate, the intimate visual depiction (e.g., URL, screenshot, description);
• A statement of your good-faith belief that the depiction was published without your consent;
• Your contact information (email address and/or phone number).

10.4 Response Timeline

Upon receipt of a valid removal request, boopstr will:

• Remove or disable access to the reported content within 48 hours;
• Make reasonable efforts to identify and remove any known identical copies of the content within boopstr.

10.5 Bluesky-Federated Content

Content that users choose to post to Bluesky via boopstr is governed by Bluesky's moderation policies. If NCII appears in Bluesky-federated content, you must report it directly through Bluesky's reporting mechanisms. boopstr cannot guarantee removal of content that has propagated across the federated AT Protocol network, but we will remove such content from display within our Services upon valid request.

10.6 Good Faith Protection

boopstr shall not be liable for good-faith removal of content reported as NCII, regardless of whether the content is ultimately determined to be unlawful.

10.7 False Reports

Submitting false or fraudulent NCII removal requests is prohibited and may result in account termination and legal consequences.

11. Federation & AT Protocol

• boopstr uses or interoperates with the Bluesky AT Protocol. Some actions may be visible across the federated network if you choose to share to Bluesky.
• Deletion within boopstr may not immediately propagate to all federated services.
• boopstr-only content (pet profiles, memorials, wishlists) remains within boopstr and is not published to the AT Protocol unless you explicitly choose to share.

12. Third-Party Services & Integrations

boopstr integrates with or relies on third-party services, including but not limited to:

• Bluesky Social (social graph and sign-in)
• Supabase (server-side implementation and storage; we never save user passwords)
• Altcha (human verification)

These services have their own terms and privacy policies, which apply when you use their features within boopstr. boopstr does not control third-party content or availability.

13. Open Source Software

• The Services may include or interoperate with open source software components (e.g., AT Protocol, Altcha) distributed under their respective licenses.
• Such licenses remain in full force and effect and may grant you rights to the source code or impose obligations; where required, we will provide license notices and source availability information.

14. Memorial Pages & Special Handling

• Memorial content is treated with heightened respect. We do not use memorial content for advertising.
• Users should ensure they have rights to share images and stories included in memorials.
• Memorial content may be retained indefinitely unless removal is requested by an authorized party.

15. Revenue & Fees

• boopstr may be free to use; certain features or third-party commerce may involve fees or affiliate revenue from ethical partnerships.
• We never sell your personal data to generate revenue.
• Advertising is not part of our current model. If the landscape changes, we will always put your data privacy first.

16. Disclaimers

• The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
• We do not guarantee that the Services will be secure, error-free, or uninterrupted.
• We are not responsible for third-party services, content, or networks.

17. Limitation of Liability

• To the fullest extent permitted by law, boopstr and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our aggregate liability for any claims relating to the Services will not exceed the greater of $50 or the amount you paid to us in the 12 months preceding the claim.

18. Suspension & Termination

• You may stop using the Services at any time and may request deletion of your account where applicable.
• We may suspend or terminate access if you violate these Terms or to protect the community or Services.
• Upon account deletion, your data will be removed in accordance with our Privacy Policy data retention schedule.

19. Apple App Store and Google Play Required Terms

• These Terms are between you and boopstr, not Apple Inc. or Google LLC ("App Stores").
• boopstr, not the App Stores, is solely responsible for the Services and for addressing any claims related thereto (e.g., product liability, legal compliance, or intellectual property infringement).
• The App Stores have no obligation to furnish any maintenance and support services with respect to the Services.
• You acknowledge that the App Stores are third-party beneficiaries of these Terms and may enforce these Terms against you.
• You must also comply with all applicable App Store terms when using the Services.

20. Changes to These Terms

• We may update these Terms from time to time. If changes are material, we will provide notice (e.g., email for waitlist users or in-app notice).
• Your continued use after changes go into effect constitutes acceptance of the updated Terms.

21. Governing Law; Venue; Dispute Resolution

• These Terms are governed by the laws of the State of Delaware and the State of California, without regard to conflicts of law.
• Venue for disputes will be in courts located in Delaware or California, as permitted by law. Nothing herein prevents either party from seeking equitable relief.

22. Dispute Resolution; Arbitration; No Class Actions

• Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, administered by a recognized arbitration provider (such as the American Arbitration Association), rather than in court.
• Exceptions: You may bring claims in small claims court if they qualify.
• No Jury Trial: By agreeing to arbitration, you waive the right to a jury trial.
• Class Action Waiver: All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one user's claims.
• Governing Law: This arbitration agreement is governed by the Federal Arbitration Act (FAA), Delaware law, and California law, as applicable.

23. Severability

• If any provision of these Terms (including the arbitration or class action waiver) is found unenforceable, the remainder of the Terms will continue in full force and effect.
